These Terms of Service (“Terms”) govern your access to and use of heathers-footwear.us (the “Site”) and your purchase of products from Heathers Footwear (“we”, “us”, “our”). By accessing the Site or placing an order, you agree to these Terms.
1. Use of the Site
You may use the Site only for lawful purposes and in accordance with these Terms. You must not interfere with the Site’s security, attempt unauthorized access, scrape data, or engage in fraudulent or misleading activity.
2. Products & Availability
Product details (including images, materials, and design features) are displayed on each product page. We strive to present items accurately, but we cannot guarantee perfect display across all screens and devices. We may change or discontinue products at any time.
3. Pricing & Currency
All prices are shown in USD.
Shipping fees (if applicable) appear at checkout or on our Shipping Information page. Promotional pricing may be limited-time and subject to conditions.
4. Orders & Payment
Placing an order constitutes an offer to purchase. We may accept or decline any order (e.g., out-of-stock items, pricing errors, or suspected fraud).
Payments are processed through our designated payment service provider. By purchasing, you authorize them to charge your selected payment method for the total amount at checkout. We may request additional verification prior to accepting an order.
5. Shipping & Delivery
Processing time: Orders are prepared within 1–2 business days (Mon–Sat).
Delivery timeframe: Once dispatched, deliveries typically arrive within 5–11 business days (Mon–Sat).
Delivery times may vary due to carrier capacity, peak seasons, public holidays, security checks, or other factors outside our control. For complete details, see our Shipping Information page. Tracking information will be emailed once your parcel ships.
Title and risk pass to you once the order is delivered to the address you provided at checkout.
6. Returns, Exchanges & Refunds

Change of mind: Returns may be started within 30 days of delivery if items are unused, in original condition, and in original packaging. Return postage for change-of-mind returns is not covered by us.
How to start:
Email support@heathersfootwear.com with your order number and reason. We will reply with instructions and the correct warehouse return address.
Where to send:
All returns must be sent to our returns facility in China. The full address is provided in our confirmation email. Returns sent without prior confirmation may be delayed or refused.
Exchanges & faulty items:
If your item arrives damaged or defective, contact us within 7 days with photos. We will arrange a replacement or refund after assessment. In such cases, we cover reasonable return postage.
Nothing in these Terms limits your rights under applicable consumer protection laws.

7. Cancellations
You may request cancellation within 1 hour of purchase, provided the order has not yet been processed.

8. Prohibited Conduct
You must not use the Site to:
(a) engage in illegal activity;
(b) infringe intellectual property or privacy rights;
(c) harass, defame, or harm others;
(d) transmit malware or spam;
(e) attempt unauthorized access to our systems.
9. Intellectual Property
All content on the Site—including text, graphics, logos, product images, and code—is owned by or licensed to us and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works without written permission.

10. User Content (Reviews, Photos, Comments)
If you submit reviews or other content, you grant us a non-exclusive, worldwide, royalty-free license to use, reproduce, and display that content in connection with the Site and our business, including marketing. You are responsible for ensuring you hold the rights to any content you submit.

The Site may link to third-party websites or services (such as payment gateways or shipping carriers). We are not responsible for their content or practices. Your use of third-party services is at your own risk and subject to their policies.
12. Warranties & Disclaimers
To the fullest extent permitted by law, the Site and products are provided “as is” and “as available”. We disclaim all express or implied warranties regarding the Site or products.
This does not limit non-excludable rights under applicable consumer laws.
13. Limitation of Liability
To the maximum extent permitted by law, we are not liable for indirect, incidental, special, or consequential damages, including lost profits, arising from your use of the Site or purchase of products.
Our total liability is limited to the amount you paid for the item causing the claim.
Nothing in these Terms limits liability where doing so would be unlawful.
14. Indemnity
You agree to indemnify and hold us harmless from any claims, losses, damages, or expenses (including legal fees) arising from your breach of these Terms or misuse of the Site.
15. Governing Law & Jurisdiction
These Terms are governed by general contract principles applicable to online commerce.
You agree that any disputes arising from your use of the Site will be handled according to applicable laws relating to cross-border e-commerce.
